This is the most common and most dangerous gap we find in Modesto. Somebody moves out of their house, rents it to a tenant, and leaves the homeowners policy exactly as it was. Nothing happens for two years — and then something does.

A homeowners policy is written on the understanding that you live there. It’s an owner-occupied form. When the house becomes a rental, the carrier is insuring a fundamentally different risk than the one they agreed to — and they didn’t agree to it.

The consequences show up at the worst possible moment. A claim can be denied because the property no longer matched the policy. Or the carrier discovers the change and cancels or non-renews you — and now you’re looking for coverage in California’s hard property market with a cancellation on your record. That’s a genuinely bad position.

The fix takes one phone call. Tell us the property is being rented and we’ll move it to the right policy. If you inherited a house, moved in with a partner and kept the old place, bought a rental, or built an ADU out back — same conversation. Do it before the tenant moves in, not after a claim.

The structure itself — fire, wind, and other covered perils. Insure to rebuild cost, not market value or what you paid. Those are three different numbers.

If a covered loss makes the unit unlivable, this replaces the rent while it’s repaired. The mortgage doesn’t pause for a fire — this is what keeps you current.

⚖️ Landlord Liability

A tenant or guest is injured on the property and you’re sued. Covers defense costs too — which matter even when the claim is baseless.

Appliances, window coverings, lawn equipment, and furnishings you own at the property. Tenant belongings are never covered — that’s their renters policy.

Policy Forms

DP-1, DP-2, DP-3 — and why it matters

Landlord policies are written on dwelling fire forms, and there are three tiers. Nobody explains this, and the difference between them is enormous at claim time.

DP-1 — basic. Covers a short named list of perils and often pays actual cash value, meaning depreciation comes out of your check. Cheapest, and the one that disappoints people most.

DP-2 — broad. A longer list of named perils and typically replacement cost on the structure. A real step up.

DP-3 — special. The broadest. Instead of listing what’s covered, it covers everything except what’s specifically excluded, and typically pays replacement cost. This is what we recommend whenever a carrier will write it.

Why care? Named-peril versus all-risk decides who has to prove what. On a DP-3, a loss is covered unless the carrier can point to an exclusion. On a DP-1, you’re covered only if your loss appears on the list. That’s a very different conversation after a fire.

And the actual cash value trap is worth understanding plainly: ACV subtracts depreciation. A twenty-year-old roof destroyed in a fire pays out as a twenty-year-old roof — not as the new roof you’ll actually have to buy. On rental property, where margins are already thin, that gap can be the difference between rebuilding and selling.

Require It In The Lease

Make your tenants carry renters insurance

This is the cheapest risk management available to a landlord, and it costs you nothing. Write a renters insurance requirement into your lease and ask for proof at signing.

Two things happen when you do. First, your tenant’s belongings become their problem, not a dispute with you. Your policy never covers tenant property — but a tenant who lost everything in a fire and has no coverage will very often come looking at you anyway.

Second, and more valuably: their renters policy includes liability coverage. If your tenant leaves a candle burning or their dog bites a neighbor, their liability responds first — before anyone gets to your policy. That’s a real layer of protection between an incident and your own limits.

The California Problem

Rentals are harder to place right now — here’s why

California’s property insurance market has tightened for everyone, and rental property is often the first thing carriers cut back on. Owner-occupied homes get priority; investment property is where appetite disappears first.

Things that make a rental harder to place: an older roof, outdated electrical or plumbing, prior water damage claims, a vacancy between tenants, or simply a carrier deciding to write less property business in California overall.

If you’ve been non-renewed on a rental, the process is the same one we use for homes: standard carriers first, surplus lines second, FAIR Plan with a wrap only if we have to. One thing to watch closely: vacancy. Most policies restrict coverage once a property has been empty beyond a certain period, and that restriction is often stricter than owners realize. If you’re between tenants, doing a long renovation, or holding a property empty, tell us — a vacancy endorsement or a builder’s risk policy is usually the answer, and finding out after a break-in is the wrong time.

Can I keep my homeowners policy if I rent the house out?

No. Homeowners policies are written for owner-occupied homes. Renting the property out without changing coverage risks a denied claim or a cancellation — and a cancellation makes finding new coverage in California’s current market much harder. Call us before the tenant moves in.

Does my policy cover my tenant’s belongings?
